The issue in this grievance is whether management violated the National Agreement by not declaring the job in question vacant and posting it for bid. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. Whether Clerk Sadler was utilized as a 204-B (acting supervisor) in excess of 4 months is a local issue suitable for regional determination by application of Article 37.3.A(7) of the National Agreement to the fact circumstances. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration, if necessary.
