This Step 4 Settlement Agreement involved whether management improperly awarded a window clerk position to an employee other than the grievant. After further review of this matter, the parties mutually agreed that whether or not the grievant should have been awarded the subject Window Clerk position could only be determined by applying Article 37, Section 3.F.7, to the fact circumstances. We further agreed that simply because an employee relinquishes a window assignment at one station does not necessarily preclude that employee from exercising a bid option for a similar position at another station.
