The question raised in this grievance is whether management properly placed the grievant in a lower level permanent light duty assignment. The facts in this case indicate that the grievant is level 6, Step 12, full-time distribution clerk. Management received medical documentation which indicated the grievant was physically unable to continue working as a machine operator. A subsequent medical report made by a physician designated by the Postal Service concurred with the grievant's physician. Based on the medical findings, the grievant was offered a permanent light duty assignment, PS-4 Mail Distributor, which he voluntarily accepted. The union contends that when an employee requests permanent light duty, management must place the employee in a pay level equivalent to his former position. It is our position that no national interpretive issue involving the terms and conditions of the National Agreement is fairly presented in this case. Inasmuch as the union declined mutual agreement in this regard, the following represents the decision of the Postal Service on the
particular fact circumstances involved.
