The issue in this grievance is whether management violated the provisions of the National Agreement and the EL-801 when prohibiting the wearing of post or stud type earrings by employees while working around letter sorting machines. It is our position that no national interpretive issue involving the terms and conditions of the National Agreement is fairly presented in this case. However, inasmuch as the union did not agree, the following represents the decision of the Postal Service on the particular fact circumstances involved. Further, it is the position of the Postal Service that the provisions of the EL-801 specifically Appendix A (page 17) under the heading "jewelry" is the reference that applies to this situation. It states, "... Persons working around moving machinery parts should never wear Jewelry, including necklaces, neck chains, earrings..." Accordingly, this grievance is denied.
