No adverse inference will be drawn by either party or an arbitrator as a result of a telephonic and/or electronic discussion and review at Step 3 or direct appeal reviews. These discussions/reviews have the same contractual force and effect as if the parties met in person. This MOU is without precedent and cannot be cited for any other purpose, other than enforcing this agreement.
