The question raised in this grievance is whether or not management violated provisions of Articles XVII and XXXI of the National Agreement in denying the Union's request to review the Official Personnel Folders of two (2) employees in connection with the filling of an Office Machine Operator, level 5, position. Our review of the information contained in the file disclosed no evidence that the Union obtained a written statement from the employees involved in this case to review their folders as required under the provisions of Chapter 3 (specifically 313.54) of the Employee and Labor Relations Manual (ELM). In the absence of such written permission, the decision by management to deny the request was proper and not contrary to the provisions of the National Agreement. Accordingly, as we find no violation of the National Agreement, this grievance in denied.
