The issue in this grievance is whether the duties of ODIS and in-office cost system should be compensated at the level 6 rate. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We further agreed that this issue is suitable for regional determination by application of the pre-arbitration settlement in Grievance No. AC-C-654/5DSM-36 which states:
"Prospectively, a level 5 employee who is assigned to complete Form 1300 of the ODIS test but who is not responsible for performing any other more significant duties of Data Collection Technician is not entitled to level 6 pay. Other significant duties would include conducting the RPW or a combination of RPW, and other data collection activities on the given tour. In addition, all instances where level 5 clerks (1) replace or substitute for Data Collection Technicians, or (2) are assigned to handle all Data Collection Technician duties which may arise during the hours of such assignment, such clerks are entitled to level 6 pay."
Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if
necessary.
